UPDATE: Section 301 Trade Remedies Assessed on Certain Products from China; Third List of Products Subject to the Section 301 Remedy.
The additional import duties for Chinese goods covered by the September 21, 2018 list of products subject to the Section 301 action are effective with respect to goods entered, or withdrawn from warehouse for consumption, on or after 12:01 AM eastern daylight time on September 24, 2018.
Any article classified in a subheading covered by the September 21 list that is a product of China is subject to a 10% ad valorem duty rate, in addition to the general (Column 1) rate of duty for that particular subheading.
There are two special tariff numbers that will apply to goods covered by the September 21, 2018 list, 9903.88.03 and 9903.88.04. Heading 9903.88.03 covers all subheadings listed in U.S. note 20(f) to Subchapter III to Chapter 99 (5,734 eight-digit HTSUS subheadings); heading 9903.88.04 covers all subheadings listed in U.S. note 20(g) to Subchapter III to Chapter 99 (11 eight-digit HTSUS subheadings with partial exceptions at the 10-digit level).
In addition to reporting the Chapter 1-97 HTSUS classification of the imported merchandise, importers shall also report the relevant 9903.88.03 or 9903.88.04 special tariff number for goods subject to the additional duty assessment of 10% ad valorem as a result of the Section 301 trade remedy.
9903.88.03: 10% ad valorem additional duty for articles the product of China,… as enumerated in U.S. note 20(f) to Subchapter III to Chapter 99.
9903.88.04: 10% ad valorem additional duty for articles the product of China,… as enumerated in U.S. note 20(g) to Subchapter III to Chapter 99.
Please note that in accordance with Annex B to the September 21, 2018 notice of action, effective 12:01 AM Eastern Standard Time on January 1, 2019, the additional rates of duty imposed by headings 9903.88.03 and 9903.88.04 will increase to 25% ad valorem.
The product descriptions provided in Annex C to the September 21, 2018 notice of action are provided for informational purposes only, and are not legally controlling. The provisions of the relevant HTSUS subheadings listed in Annex A are controlling for the purpose of determining whether a good is subject to the Section 301 remedy.
New Statistical Reporting Number for Subheading 8517.62.00, HTSUS
U.S. note 20(g)(2) to Subchapter III to Chapter 99 indicates that heading 9903.88.04 applies to articles classified in subheading 8517.62.00, except for machines provided for in statistical reporting number 8517.62.0090. 8517.62.0090 is a new statistical reporting number that will be added to the HTSUS on or before September 24, 2018. Products Covered by the June 20, 2018 and August 16, 2018 Lists for the Section 301 Action

In addition to reporting the Chapters 1-97 HTSUS classification of the imported merchandise, importers shall also report the 9903.88.01 special tariff number for goods subject to the additional duty assessment of 25% ad valorem as a result of the Section 301 trade remedy.
The additional import duties for Chinese goods covered by the August 16, 2018 list were effective with respect to goods entered, or withdrawn from warehouse for consumption, on or after 12:01 AM eastern daylight time on August 23, 2018.
In addition to reporting the Chapter 1-97 HTSUS classification of the imported merchandise, importers shall also report the 9903.88.02 special tariff number for goods subject to the additional duty assessment of 25% ad valorem as a result of the Section 301 trade remedy
The Section 301 duties only apply to products of China, and are based on the country of origin, not country of export.
The additional duties imposed by headings 9903.88.01 through 9903.88.04 do not apply to goods for which entry is properly claimed under a provision of chapter 98 of the HTSUS, except for goods entered under headings 9802.00.40, 9802.00.50, 9802.00.60, and 9802.00.80. For headings 9802.00.40, 9802.00.50, and 9802.00.60, the additional duties apply to the value of repairs, alterations, or processing performed abroad, as described in the applicable heading. For heading 9802.00.80, the additional duties apply to the value of the article less the cost or value of such products of the United States, as described in heading 9802.00.80.

When submitting an entry for a Temporary Importation under Bond (TIB), a filer must first report the applicable subheading in Chapter 98 (i.e., in heading 9813), followed by subheading 9903.88.01/02/03/04, and the Chapter 1-97 HTSUS for the commodity being imported.
Products of China that are covered by the Section 301 remedy and that are eligible for special tariff treatment under general note 3(c)(i) to the tariff schedule, or that are eligible for temporary duty exemptions or reductions under subchapter II to chapter 99, shall be subject to the additional 25 percent ad valorem rate of duty imposed by headings 9903.88.01 and 9903.88.02, or the additional 10 percent ad valorem rate imposed by heading 9903.88.03 and 9903.88.04.
Section 301 duties are eligible for duty drawback.

MUST-READ Update on China Section 301 Tariffs
The list contains 5,745 full or partial lines of the original 6,031 tariff lines that were on a proposed list of Chinese imports announced on July 10, 2018. Changes to the proposed list were made after USTR and the interagency Section 301 Committee sought and received comments over a six-week period and testimony during a six-day public hearing in August. The Office of USTR believes they engaged in a thorough process to rigorously examine the comments and testimony and, as a result, determined to fully or partially remove 297 tariff lines from the original proposed list.
If you filed comments or gave testimony in an attempt to get something removed, remember, it was not a waste of your time. Your comments appear to have been largely ignored by the President, who, it appears, is taking this abrupt action in an attempt to accelerate talks with the Chinese toward a negotiated agreement. Your comments and testimony may well influence the U.S. position in the talks.

Q and A.
Q1. What is on the final list?
A1. The official list is available HERE
Q2. What lines were removed?
A2. USTR has made the following general statement:"Included among the products removed from the proposed list are certain consumer electronics products such as smart watches and Bluetooth devices; certain chemical inputs for manufactured goods, textiles and agriculture; certain health and safety products such as bicycle helmets, and child safety furniture such as car seats and playpens."

Q3. An article I import from China is on the list? What can I do?
A3. Unless you can quickly change your sourcing, or defer imports, you should prepare to start paying an additional 10% duty starting on September 24, 2018. It will likely be temporary, but no one knows how long it will be in effect or whether it will continue with a 25% rate starting January 1, 2019.
Q4. Is there any chance it may not go into effect?
A4. Yes, it is widely understood that the President is taking actions against China to bring China to the negotiation table and get a better trading arrangement for the U.S. It is possible that he could accomplish that before the tariffs go into effect. It is also possible that a deal could be made within a few weeks, limiting the duration of the harm. It is also possible that a court may delay it (see question 5, below).
Q5. Is this even legal? All these list suddenly released looks like he's making it up as he goes along, rather than following regulatory procedures.
A5. Good point.
The Consumer Technology Association ("CTA") has filed comments challenging the legality of List 3 (see the history below if you want to clarify the three lists). CTA contends that the administration did not have the authority to impose new tariffs -- beyond the two lists of tariffs already in effect -- without initiating a new investigation."Section 301 does not authorize the additional $200 billion in List 3 tariffs, for at least two reasons," the submission states. "First, the announcement of the List 3 tariffs came well outside the 30-day limit imposed by Section 305 of the Trade Act. Second, the List 3 tariffs were based on impermissible reasons post-dating the Section 301 investigation --namely, 'China's response to the $50 billion action announced in the investigation and its refusal to change its acts, policies, and practices,' -- rather than on the original Section 301 investigatory findings, as the statute requires." CTA further argues that Section 307 of the 1974 trade law does not permit the administration to modify remedies indefinitely. "It does not authorize USTR to impose brand new penalties that more than quadruple those imposed following the original investigation," the submission says. "Nor does it offer the Administration a blank check to increase tariffs at any time based on events post-dating the initial Section 301 investigation. Such unfettered discretion is inconsistent with the fact-based determination required by Section 301."
Another consideration is the timing. Just 12 days after the close of the September 6, 2018, comment period, and just two days after the transcript of the hearing was made available on regulations.com, USTR announced the final list. There is no way that government bureaucrats had time to fully analyze over 6,000 comments and testimony from over 300 witness in such a short time. One can argue that once you acknowledge that the proposed action requires consideration of public comments, you cannot then move ahead without even reading those comments.
Would a legal challenged based on the assertions above be successful? It may not be necessary to prevail, merely finding one judge to stay the action pending a full court hearing would, at least for a considerable time, stop the tariffs.
Q6. What about filing for an exclusion by the October 9, 2018, deadline?
A6. As of now there is no provision for filling for an exclusion from List 3 tariffs. The October 9th deadline refers to List 1. If List 3 tariffs are imposed it is generally expected that an opportunity to file for exclusion will be announced when they go into effect or shortly after. However, the extremely high volume of exclusion requests expected will put a tremendous strain on the government to process them, with the result that they may take more than the 90 days they are supposed to take to complete. Q7. What about duty suspensions under the Miscellaneous Tariff Bill?
A7. If you successfully filed for a temporary duty suspension under the recently enacted MTB, those duty suspensions will go into effect as scheduled, 30 days from enactment. So if you currently pay duty on an article from China and it's on the MTB list, you will avoid the general duty. However, if the Section 301 duties go into effect you cannot avoid them. They are in addition to the general rate and unaffected by the MTB.
Q8. Can I use a Foreign-Trade Zone to avoid 301 duties?
A8. Possibly. If you use inputs subject to 301 duties and subsequently export those articles, either in the same condition, or after manufacturing, you can avoid 301 duties on exports using FTZ procedures. FTZ procedures will also avoid 301 duties on materials that become waste in the manufacturing process.
HISTORY: THE INVESTIGATION THAT SET THIS ALL IN MOTION
On August 14, 2017, the President issued a Memorandum (82 FR 39007) instructing the Trade Representative to determine whether to investigate under section 301 of the Trade Act of 1974 (Trade Act) (19 U.S.C. 2411), laws, policies, practices, or actions of the Government of China that may be unreasonable or discriminatory and that may be harming American intellectual property rights, innovation, or technology development. On August 18, 2017, after consultation with the appropriate advisory committees and the interagency Section 301 Committee, USTR initiated an investigation into certain acts, policies, and practices of the Government of China related to technology transfer, intellectual property, and innovation.
The findings of this investigation were the basis for President Trump's proposal to impose additional tariffs on certain goods of Chinese origin. So far two tranches of tariffs have been imposed and a third is scheduled to be implemented on September 24, 2018.
TRANCHE ONE
On April 3, 2018, USTR released a proposal to place an additional 25% import duty on products covered by 1,333 tariff classifications. The list was published in the April 6, 2018, Federal Register (83 FR 14906).
Interested persons filed approximately 3,200 written submissions. In addition, USTR and the Section 301 Committee convened a three-day public hearing from May 15-17, 2018, during which 121 witnesses provided testimony and responded to questions. Post-hearing comments were accepted through May 22, 2018. 515 items were removed from the list.
On June 15, 2018, 24 days after the close of the comment period, USTR announced the final list.
On July 6, 2018, additional tariffs of 25% began to be applied to those 818 lines.
On July 11, 2018, five days after implementing the tarffs, USTR posted in the Federal Register (83 FR 32181) procedures to apply for exclusions from the 25% tariff on items covered by Tranche 1. The deadline to apply for an exclusion is October 9, 2018. If an exclusion is granted it will be retroactive to July 6th.
TRANCHE TWO
On June 15, 2018, USTR released a proposal to place an additional 25% import duty on products covered by 284 tariff classifications. The list was published in the June 20, 2018, Federal Register (83 FR 28710).
On August 8, 2018, eight days after the close of the July 31, 2018, comment period, USTR announced a list containing 279 of the original 284 tariff lines that were on a proposed list that will be subject to 25% additional tariffs. These went into effect August 23. On September 18, 2018, USTR published in the Requests for exclusions from the additional 25 percent tariff imposed as of Aug. 23 on goods classified under 284 tariff lines when imported from China are due by December 18.
TRANCHE THREE
On July 6, 2018, in response to unfair Chinese practices, the United States began imposing tariffs of 25 percent on approximately $34 billion worth of Chinese imports. These tariffs will eventually cover up to $50 billion in Chinese imports as legal processes conclude. The products targeted by the tariffs are those that benefit from China’s industrial policy and forced technology transfer practices. China has since retaliated against the United States by imposing tariffs on $34 billion in U.S. exports to China, and threatening tariffs on another $16 billion. The U.S. claims that China did this without any international legal basis or justification. As a result of China’s retaliation and failure to change its practices, the President has ordered USTR to begin the process of imposing tariffs of 10 percent on an additional $200 billion of Chinese imports. The U.S. maintains that this is an appropriate response under the authority of Section 301 to obtain the elimination of China’s harmful industrial policies.
On July 17, 2018, USTR posted a third list, this one with over 6,031 items. Comments were due September 6.
On September 17, 2018, (just 12 days after the close of the September 6, 2018, comment period, and just two days after the transcript of the hearing was made available on regulations.com) USTR announced the final tranche 3 list of 5,745 full or partial lines of the original 6,031 tariff lines as the final tranche 3 list with 10% additional tariff to be imposed starting September 24, 2018, and rising to 25% on January 1, 2019. They fully or partially removed 297 tariff lines from the original proposed list. Included among the products removed from the proposed list are certain consumer electronics products such as smart watches and Bluetooth devices; certain chemical inputs for manufactured goods, textiles and agriculture; certain health and safety products such as bicycle helmets, and child safety furniture such as car seats and playpens. Most observers expect that tranche 3 will have an exclusion procedure, as did tranche 1 and tranche 2. It will likely be announced in a few weeks. >

Hockey Puck Seller, Companies Selling Recreational and Outdoor Equipment Agree To Stop Making False ‘Made in USA’ Claims in Separate Actions
In two Federal Trade Commission cases, companies selling hockey pucks and companies selling recreational and outdoor equipment agreed to stop making false “Made in USA” claims. Four related Farmingdale, New York-based companies doing business as Patriot Puck, and their officer, have agreed to stop making false claims that the hockey pucks they sell are all, or virtually all, made in the United States. Also, two commonly controlled California companies that sell recreational and outdoor equipment have agreed to stop making false, misleading, and unsupported “Made in USA” claims about their products.
What the FTC Did to Protect Consumers
In the Patriot Puck matter, the FTC’s complaint, which names George Statler III as an officer of all the companies, alleges Patriot Puck markets hockey pucks -- through its website, patriotpuck.com, and elsewhere online -- to customers throughout the United States. According to the complaint, Patriot Puck’s claims in its advertising, packaging, and promotional materials include “Made in America,” “Proudly Made in the USA,” “100% American Made!” and “The only American Made Hockey Puck!”.
The FTC alleges that, in fact, Patriot Puck’s hockey pucks are wholly imported from China. Since January 2016, Statler and the companies doing business as Patriot Puck – which include Underground Sports Inc., Hockey Underground Inc., Ipuck Inc. and Ipuck Hockey Inc. – have imported 74,411 kilograms of hockey pucks, which is the equivalent of more than 400,000 standard-weight pucks, the complaint states.

In the matter involving California companies Sandpiper of California, Inc. and PiperGear USA, Inc., the FTC’s complaint alleges that the companies claimed in advertisements, product labels, and promotional materials, and on company websites and social media, that their backpacks, travel bags, wallets, and other products are all or virtually all made in the United States.
But more than 95 percent of Sandpiper’s products are imported as finished goods, and approximately 80 percent of PiperGear’s products either are imported as finished goods, or contain significant imported components. According to the complaint, in some wallets imported as finished goods, the companies hid truthful country-of-origin information on the back of tags, and inserted cards that prominently displayed false U.S.-origin claims.
Sandpiper and PiperGear market their products -- which also include tactical gear and personal security items -- throughout the United States, according to the complaint. Much of their allegedly false promotional material appeals to consumers’ patriotism. For example, Exhibit D is a Sandpiper logo that includes an American flag and the claim “U.S. Made By S.O.C.” (Sandpiper of California).
Similarly, according to the complaint, Sandpiper’s website states: “Featuring American Made products developed and manufactured by our sister company, PiperGear USA.”

What the Settlements Mean
Under the terms of the proposed settlement orders, Statler and the four Patriot Puck companies, as well as Sandpiper and PiperGear, are prohibited from making unqualified U.S.-origin claims for their products, unless they can show that the products’ final assembly or processing -- and all significant processing -- take place in the United States, and that all or virtually all ingredients or components of the product are made and sourced in the United States.
Under the orders, any qualified Made in USA claim must include a clear and conspicuous disclosure about the extent to which the product contains foreign parts, ingredients, and/or processing. To claim that a product is assembled in the United States, the respondents in both cases must ensure that it is last substantially transformed in the United States, its principal assembly takes place in the United States, and United States assembly operations are substantial.
The orders also prohibit the respondents from making untrue, misleading, or unsubstantiated country-of-origin claims in their marketing materials about any product or service.
In a related matter, following a public comment period, the Federal Trade Commission has approved a final consent order settling charges that California-based Nectar Brand LLC made false claims that its Chinese-made mattresses are assembled in the United States.
First announced in March 2018, the FTC’s complaint against Nectar Brand LLC alleged that the company falsely claimed its mattresses are “Designed and Assembled in the USA,” but in fact, the mattresses are wholly imported from China, with no assembly taking place in the United States.

For 50 Years the Navy Peacoat Has Been Made Here in Boston, Let's Fight for It!
For more than a century, the peacoat has been a staple in the seabags of new-enlisted sailors. It is one of the most iconic and recognizable symbols of a strong U.S. Navy. Its natural wool construction is virtually impervious to cold, making it ideal for colder climates, and when adorned with Navy insignia, makes a statement about a special and valued group of patriots.
The loss extends beyond the Navy, though. The U.S. woolen textile industry, centered in New England, with small to medium businesses in the chain throughout the U.S., is likely to be hard hit by this change. The shift away from the peacoat could mean millions of dollars in lost revenue and the potential loss of thousands of jobs.
Since 1968 all official U.S. Navy peacoat been made right here in the City of Boston, at the Fredella family's East Boston, Sterlingwear of Boston, factory. Good-paying manufacturing jobs in Boston are at risk. Factories in the supply chain that will be affected are located in Massachusetts, Connecticut, Rhode Island, and Pennsylvania. Thousands of sheep farmers in the Western States will also be harmed when the wool peacoat is dropped by the Navy.

Commercial Customs Operations Advisory Committee (COAC) Meeting Set for October 3rd
Agenda
The Designated Federal Officer will announce how the COAC subcommittees will be re-organized to align with CBP's trade strategic priorities and outline how the current and future COAC activities will be structured within each subcommittee. The COAC will hear from the current subcommittees on the topics listed below and then will review, deliberate, provide observations, and formulate recommendations on how to proceed:
1. The Trusted Trader Subcommittee will present an update on CTPAT Minimum Security Criteria work and its socialization period. The subcommittee will also provide an update on the Forced Labor Strategy for CTPAT Trade Compliance and the CBP lead will report on the progress of the Trusted Trader Pilot.
2. The Trade Enforcement & Revenue Collection (TERC) Subcommittee will provide necessary updates from the Anti-Dumping and Countervailing Duty, Bond, Forced Labor and Intellectual Property Rights Working Groups.
3. The COAC Trade Modernization Subcommittee will discuss the E-Commerce Working Group's progress in addressing CBP's strategic plan regarding e-commerce threats and opportunities to both the government and trade and in light of the World Customs Organization's global framework. The Regulatory Reform Working Group will provide an overview of work accomplished in reviewing the regulations contained in Title 19 of the Code of Federal Regulations to reduce regulatory burdens and costs. The Foreign Trade Zone Working Group will present recommendations regarding the updating of 19 CFR part 146, the Foreign Trade Zone Regulations. They will also discuss a proposed revision to 19 CFR part 146 that began in 2015 and was referred to the working group for further input.
4. The Global Supply Chain Subcommittee will provide a status update on the following work group activities: Piloting the use of the Automated Commercial Environment (ACE) to electronically report and manage petroleum moving in-bond via pipeline; the Emerging Technologies Working Group's work on NAFTA/CAFTA and the Intellectual Property Rights Blockchain Proof of Concept projects; and the In-bond Working Group's review of the draft Automated In-Bond Business Process document; as well as potential automation, visibility, system issues and policy/regulatory updates.
