Revocation of One Ruling Letter and Revocation of Treatment Relating to the Tariff Classification of a Woman’s Top

In New York Ruling Letter (“NY”) N324185, CBP classified a woman’s top in heading 6211, HTSUS, specifically in subheading 6211.42.10, HTSUS, which provides for “Track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls’: Of cotton: Other.” CBP has reviewed NY N324185 and has determined the ruling letter to be in error. It is now CBP’s position that the woman’s top is properly classified in heading 6206, HTSUS, specifically in subheading 6206.30.30, HTSUS, which provides for “Women’s or girls’ blouses, shirts and shirt-blouses: Of cotton: Other: Other.” Pursuant to 19 U.S.C. § 1625(c)(1), CBP is revoking NY N324185 and revoking or modifying any other ruling not specifically identified to reflect the analysis contained in Headquarters Ruling Letter (“HQ”) H326573, set forth as an attachment to this notice. The sewn-in neck label displays “Made in Turkey”, “100% Cotton” and washing instructions.

Remedy: Consumers should immediately take the recalled robes away from children, stop using them and contact Bagno Milano for a full refund. Consumers who purchased the robes will be asked to destroy the robes by cutting them both vertically and horizontally and disposing of them in accordance with local state recycling laws. Consumers should send the recalling firm a photo of the destroyed robes at support@bagnomilanousa.com. Upon receipt of the photo, consumers will be issued a full refund of the purchase price. This notice is being published in accordance with Federal Acquisition Regulation (FAR) Part 5.101(a)(1) requiring the dissemination of information on proposed contract actions. This is a notice of intent to award a sole-source contract, and is not a request for competitive proposals.

The proposed contract is for the Bath Robe Material Double Weave (Terry Cloth-75% Combed Cotton, 25% Polyester Material), MUST be BAA Complaint.

The Government intends to solicit and negotiate with only one source under Simplified Acquisition Procedures (SAP), pursuant to the statutory authority of 10 U.S.C. 2304(c)(1) as implemented by FAR Subpart 13.106-1(b)(1)(i). African Growth and Opportunity Act (AGOA): Program Usage, Trends, and Sectoral Highlights

On April 17, 2023, the U.S. International Trade Commission ("USITC") released African Growth and Opportunity Act (AGOA): Program Usage, Trends, and Sectoral Highlights Publication Number: 5419, Investigation Number: 332-589.

The report finds that the impact of the AGOA program on beneficiary countries can be substantial depending on the sector, especially apparel. Moreover, although the influence throughout SSA as a whole has been minimal, interviews by Commission staff, fieldwork, and some academic literature indicate that AGOA may have had a positive impact in key areas such as poverty reduction and job growth in some countries. The effect was found to be particularly important in the apparel sector and among underserved groups, such as women. Anecdotal evidence indicated that while meeting AGOA eligibility requirements created a positive impact on workers and poverty reduction, the loss of program eligibility due to failure to meet program requirements had a negative impact on beneficiary economies and regional integration. 

Additional highlights from the report include:

  • AGOA benefits accrue to a subset of countries and sectors within SSA. Over three-quarters of non-crude petroleum imports under AGOA originated from five countries during 2014–21: South Africa, Kenya, Lesotho, Madagascar, and Ethiopia. Countries with lower utilization rates typically have few exports to the United States in general, or their primary traded goods are not eligible for AGOA preferences or are already duty free under normal trade relations.
  • The SSA apparel sector has benefited substantially from the AGOA program. Of non-petroleum imports under AGOA, imports of textile and apparel constitute the largest share. Duty savings of up to 30 percent and the third-country fabric provision have allowed multiple countries to expand their manufacturing capacity. Employment in this sector has provided an avenue for women to enter the formal economy and earn relatively high wages. While there remains little direct usage of SSA-grown cotton and a reliance on East Asian mills for yarn and fabric, there are some limited examples of regional integration connecting SSA producers of textile inputs to apparel manufacturers.
  • Agricultural products like cotton and cocoa are important sectors for a number of SSA economies. Growing these crops employs millions of farmers across the region, and their export is critical for accessing foreign exchange. Cocoa processing operations in the region allow the export of higher-value commodities like cocoa butter and powder. However, growing cotton and cocoa provides low income and therefore does not provide a reliable pathway for poverty reduction. Additionally, higher income cocoa processing employment is limited. Child work and child labor are present in the industries, particularly on family farms.
  • Despite the SSA region’s access to ample feedstocks, the chemical industry’s potential impact across the region is limited, and substantial development will likely depend on mitigating competitive infrastructure weaknesses. South Africa is the only AGOA beneficiary or SSA country with an established and comparatively diversified chemical industry, but its growth beyond basic and commodity chemicals has been hindered because of unreliable transportation, water shortages, and a lack of dependable electricity.

Remedy: Consumers should immediately take the recalled robes away from children, stop using them and contact Goumi. Consumers should destroy the robes by cutting them both vertically and horizontally and disposing of them in accordance with local state recycling laws. Consumers should send an image of the destroyed recalled robes to Goumi by email at productrecall@goumikids.com. Monday, April 17, 2023, is Patriots' (plural possessive) Day in Massachusetts and Patriot's (singular possessive) Day in Maine. It is the day we remember that first "shot heard round the world." For the past 14 months we have witnessed the bravery of the Ukrainian patriots defending their land from Russian invasion. Just as in 1775, we see are witnessing a battle pitting the local population against a larger and better-equipped foreign power. Persons who know military and geo-political affairs better than I, can speculate on what course this war will take. If our own history is a guide, the Ukrainians are in for a long fight.

"Listen, my children and you shall hear
Of the midnight ride of Paul Revere,
On the eighteenth of April, in Seventy-five."

New England's original "On the Road" man looms large in these parts -- life-sized, in fact, in bronze, in Boston's North End. There, as well, you'll find his house preserved, just as his ride is preserved in the Longfellow poem.

The battles that morning of April 19 in the Massachusetts towns of Concord, Lexington, and Menotomy (now Arlington) officially mark the beginning of the American War of Independence. The war formally concluded September 3, 1783, with the Treaty of Paris, although it was effectively over a few months earlier. In Massachusetts and Maine (part of Massachusetts until 1820, when, under the "Missouri Compromise" Maine, a free State was admitted to the Union, paired with Missouri, a slave State) we celebrate the beginning of our independence as Patriots'/Patriot's Day, and -- we take to the road in a renowned twenty-six miles of road from Hopkinton to Boston.

The Boston Marathon has been run since 1897. The first modern marathon was run at the 1896 Olympics in Athens, Greece. The inspiration for the race was the (questionable) tale of Pheidippides, who after the Greeks, in late summer 490 B.C., won the Battle of Marathon, ran the 26 miles to Athens, said a single word "Victory," and dropped dead. At Marathon Greece, freedom, democracy, and Western civilization faced and defeated the forces of Oriental absolutism. It is a battle that has been fought many times. It will be fought many more times. Freedom must always be prepared to fight just to be free.
