Standard for the Flammability of Clothing Textiles

On October 25, 2023, the Consumer Product Safety Commisstion published in the Federal Register (88 FR 73221) Standard for the Flammability of Clothing Textiles

SUMMARY: The U.S. Consumer Product Safety Commission (Commission or CPSC) is amending the Standard for the Flammability of Clothing Textiles. The revisions clarify existing provisions, expand permissible equipment and materials for testing, and update equipment requirements that are outdated. The Commission issues this amendment under the authority of the Flammable Fabrics Act.

DATES: This rule is effective on April 22, 2024. The incorporation by reference of the publication listed in this rule is approved by the Director of the Federal Register as of April 22, 2024.

CPSC Staff will attend ASTM Subcommittee F08.22 Camping Softgoods/Tent Flammability Meeting

Emily Maling, Lisa Scott, and Allyson Tenney, Directorate for Laboratory Sciences, will be attending ASTM Subcommittee F08.22 Camping Softgoods/Tent Flammability Meeting. The meeting will take place on Thursday, June 8 from 1:00pm to 3:00pm MT in Denver, Colorado. The test method for camping tents and test data on tent materials will be discussed. CPSC will participate in a virtual meeting of the ASTM F15.81 subcommittee for PFAS in Consumer Products

On October 3, 2022, Carter Bosse of the Consumer Product Saefty Commission Office of Hazard Identification and Reduction, and other CPSC staff, will participate in the first meeting of the new ASTM F15.81 subcommittee for PFAS (per- and polyfluoroalkyl substances) in consumer products on Monday, October 3, 2022, from 11:00 AM to 12:30 PM ET. The meeting will discuss next steps in the creation of a standard guide for selecting analytical methods to evaluate PFAS in consumer products. TJX to Pay $13 Million for Letting Recalled Products Re-enter Commerce

On August 5, 2022, the Consumer Product Safety Commission published in the Federal Register (87 FR 48004 The TJX Companies, Inc.

SUMMARY: The Commission publishes in the Federal Register any settlement that it provisionally accepts under the Consumer Product Safety Act. Published below is a provisionally accepted Settlement Agreement with The TJX Companies, Inc., containing a civil penalty in the amount of $13 million, subject to the terms and conditions of the Settlement Agreement.

According to the CPSC complaint: "TJX sold, offered for sale, and distributed Recalled Products because TJX failed to implement adequate procedures to accurately identify, quarantine, and prevent the sale, offer for sale, and distribution of the Recalled Products. The deficiencies in TJX's reverse logistics and compliance programs allowed Recalled Products to reenter commerce."

DATES: Any interested person may ask the Commission not to accept this agreement or otherwise comment on its contents by filing a written request with the Office of the Secretary by August 22, 2022.

Free Birdees Recalls Children’s Pajamas Due to Burn Hazard

Description: This recall involves Free Birdees’ children’s 95% viscose and 5% spandex pajamas. The two-piece, short or long-sleeved pajamas, were sold in sizes 6-12 months, 12-18 months, 18-24 months, 2T, 3T, 4T, 5, 6, 7, 8, 10, and 12, and in three prints: green tractor, green stripe and tropical fish. Free Birdees, the size and RN 157155 are printed at the neck.

Remedy: Consumers should immediately take the recalled pajamas away from children and contact Free Birdees for a full refund. Consumers who purchased the sleepwear garments will be asked to destroy the garments by cutting them in half and send the recalling firm a photo of the destroyed garment and of the garment’s neck label. Upon receipt of the photos, consumers will be issued their choice of either a full refund or a store gift card. Free Birdees is contacting all known purchasers directly.

Copper Pearl Recalls Children’s Sleepwear Due to Violation of Federal Flammability Standards and Burn Hazard

Description: This recall involves Copper Pearl children’s pajamas made of 69% polyester, 28% rayon and 3% spandex. The two-piece, long-sleeved pajamas were sold in two prints: fawn and polar. The tight-fitting sleepwear was sold in children’s sizes 12M, 18M, 2T, 3T, 4T and 5T. “Made by Copper Pearl,” size and RN 151055 are printed at the neck.

Remedy: Consumers should immediately take the recalled sleepwear away from children and contact Copper Pearl for a full refund. Consumers who purchased the sleepwear directly from Copper Pearl will be contacted via email and provided prepaid mailers to return the garment(s) for a full refund. Consumers who purchased the sleepwear at retail locations will be asked to destroy the garments by cutting them in half and sending the firm a photo of the destroyed product, including the neck label. Upon receipt of the photos, consumers will be issued a full refund and a 20% off discount code towards another purchase.

MWA Recalls LUXE+WILLOW Heated Blankets Due to Burn and Fire Hazards

Description: This recall involves LUXE+WILLOW Heated Blankets brand name L & W BIO. LUXE+WILLOW and L&W BIO are printed on a label on the blanket. The polyester blanket measures 50 inches by 50 inches and is white with a Sherpa lining.

Remedy: Consumers should immediately stop using the recalled electric blanket and contact MWA for a full refund or $50 voucher towards the purchase of another LUXE+WILLOW product. Consumers should unplug the electric blanket, cut the electrical cord and submit a photo of the blanket’s cut cord and labeling on the blanket to the firm at support@luxewillow.com as proof of destruction and to receive the refund or $50 voucher. After submitting proof of destruction to the firm, consumers should dispose of the recalled blanket. The firm is contacting all known purchasers directly.

Incidents/Injuries: The firm has received three reports of the blankets overheating, including one report of a burn to a consumer’s wrist. One consumer reported seeing flames.

Sold At: T.J. Maxx, Urban Outfitters and other stores nationwide from January 2022 through March 2022 for about $40.

The Red League Recalls Children’s Pajamas Due to Burn Hazard

Description: This recall involves three styles of children’s sleepwear garments; one-piece, long-sleeve top and footed pajamas, two-piece, long-sleeve top and pant traditional pajama sets, and two-piece, long-sleeve top and pant pajama sets.

The one-piece, long-sleeve top and footed pajamas are red, have wooden buttons located at the back of the neck and were sold with a matching red beanie hat. The pajamas were sold in sizes 6-12 months and 12-18 months and are made of 80% cotton and 20% polyester.

The two-piece, long-sleeve top and pant traditional pajama sets are red with white piping trim, two front pockets and wooden buttons on the center front. The pajama sets were sold in children’s sizes 2, 3, 4, 5, 6, 8, 10, 12 and 14 and are made of 80% cotton and 20% polyester.

The two-piece, long-sleeve top and pant pajama sets are yellow and have a bear embroidered onto the tops’ chest. The pajama sets were sold in children’s sizes 2, 3, 4, 5, 6, 8, 10, 12 and 14 and are made of 95% cotton and 5% spandex.

“The Red League” and the size are printed on a sewn-in fabric label at the neck of the recalled garments. “Made in China,” size, fiber content and washing instructions are printed on a sewn-in, side-seam label.

Remedy: Consumers should immediately take the recalled pajamas away from children and contact The Red League to receive a pre-paid mailer and instructions on how to return the garment(s) for a full refund. The firm is also contacting consumers who purchased the pajamas directly from The Red League to provide them a prepaid mailer to return the garment for a full refund.

Sold At: Online at https://theredleague.com/ and at Elle Ella Boutique stores in California and JellyBeans stores in New York from November 2020 through February 2022 for between $38 and $40, depending on the style.

U.S. Flammability Requirements for Upholstered Furniture

Kelly Wynne Recalls Children’s Handbags Due to Violation of Federal Lead Content Ban (Recall Alert)

Description: This recall involves the Mama & Me MINI children’s leather handbags. The recalled handbags measure about 6.5 inches high, 9.5 inches wide and 3.25 inches deep and were sold in three different colors or color combinations: coral, coral/purple and taupe. The handbags have a top zipper, an interior slip pocket and a detachable, 21 inch-long, gold and leather strap that can be shortened or removed. The Kelly Wynne logo is printed on a golden sewn-in label located on the inside of the handbag. The following SKU and UPC numbers combinations can be found on the order invoice: SKU MINI505 and UPC 850023783271; SKU MINI875 and UPC 850023783288; and SKU MINI500 and UPC 850023783288.

Remedy: Consumers should immediately take the recalled handbags away from children and contact Kelly Wynne for a full refund if purchased at kellywynne.com or contact Nordstrom if purchased at Nordstrom.com. Kelly Wynne and Nordstrom are contacting all known purchasers directly, and will provide pre-paid shipping labels for consumers to return the recalled product for a full refund.
