USITC Releases 10th Annual Report on U.S. Textile and Apparel Imports from China

On Jun2 28, 2019, The U.S. International Trade Commission released its annual compilation of reports published every two weeks on textile and apparel imports from China.

This annual report for 2018 contains a compilation of the statistical reports published every two weeks by the Commission on the volume, value, unit value, and import market share of imports from China that were subject to the provisions of the 2005 U.S.-China Memorandum of Understanding Concerning Trade in Textiles and Apparel (MOU). This compilation includes official import data from the U.S. Department of Commerce, and shows data at the 3-digit textile/apparel category level and by the Harmonized Tariff Schedule 10-digit statistical reporting numbers (HTS10 or HTS10 codes) in these categories. The Commission posts updated reports every two weeks on its website at: www.usitc.gov/research_and_analysis/what_we_are_working_on.htm

Polyester Textured Yarn From India: Preliminary Affirmative Determination of Sales at Less Than Fair Value and Postponement of Final Determination and Extension of Provisional Measures

On June 26, 2019, the U.S. Department of Commerce announced the affirmative preliminary determinations in the antidumping duty (AD) investigations of imports of polyester textured yarn from China and India, finding that exporters from China have dumped polyester textured yarn in the United States at margins of 76.07 percent and 77.15 percent, while exporters from India have dumped polyester textured yarn in the United States at margins of 17.88 percent and 35.92 percent. The petitioners are Unifi Manufacturing, Inc. (Greensboro, NC) and Nan Ya Plastics Corp. America (Lake City, SC).

On July 1, 2019, the U.S. Department of Commerce published in the Federal Register notices of postponement of the final determination the cases relating to polyester textured yarn from China (84 FR 31297) and India (84 FR 31301). The normal 75-day period from preliminary determination to final determination has been extended to 135 days, or November 13, 2019.

Section 735(a)(2) of the Tariff Act of 1930 provides that a final determination may be postponed until not later than 135 days after the date of the publication of the preliminary determination if, in the event of an affirmative preliminary determination, a request for such postponement is made by exporters who account for a significant proportion of exports of the subject merchandise. Commerce requires that requests by respondents for postponement of a final antidumping determination be accompanied by a request for extension of provisional measures from a four-month period to a period not more than six months in duration.

On June 14, 2019, Fujian Billion, a Chinese exporter, requested, in the event of an affirmative preliminary determination, that Commerce postpone the final determination and that provisional measures be extended to a period not to exceed six months. Because no compelling reasons for denial exist, Commerce is postponing the final determination and extending the provisional measures from a four-month period to a period not greater than six months. Accordingly, Commerce's final determination will publish no later than 135 days after the date of publication of this preliminary determination.

On June 13, 2019, Reliance Industries Limited, an Indian exporter, requested in the event of an affirmative preliminary determination, that Commerce postpone the final determination and that provisional measures be extended to a period not to exceed six months. Because no compelling reasons for denial exist, Commerce is postponing the final determination and extending the provisional measures from a four-month period to a period not greater than six months. Accordingly, Commerce will make its final determination no later than 135 days after the date of publication of this preliminary determination.

Annual Review of Country Eligibility for Benefits Under the African Growth and Opportunity Act

The Office of the U.S. Trade Representative (USTR) is announcing the initiation of the annual review of the eligibility of the sub-Saharan African countries to receive the benefits of the African Growth and Opportunity Act (AGOA). The AGOA Implementation Subcommittee of the Trade Policy Staff Committee (Subcommittee) is developing recommendations for the President on AGOA country eligibility for calendar year 2020. The Subcommittee requests comments for this review and will conduct a public hearing on this matter.

Section 104 of AGOA includes requirements that the country has established or is making continual progress toward establishing, among other things:

  • A market-based economy
  • the rule of law
  • political pluralism
  • the right to due process
  • the elimination of barriers to U.S. trade and investment
  • policies to reduce poverty
  • system to combat corruption and bribery
  • of internationally recognized worker rights

In addition, the country may not engage in activities that undermine U.S. national security or foreign policy interests or engage in gross violations of internationally recognized human rights. Section 502 of the 1974 Act provides for country eligibility criteria under GSP. For a complete list of the AGOA eligibility criteria and more information on the GSP criteria, see section 104 of the AGOA and section 502 of the 1974 Act.

The Secretary of Labor may consider comments related to the child labor criteria to prepare the U.S. Department of Labor's report on child labor as required under section 504 of the 1974 Act.

U.S. Department of Commerce Issues Affirmative Preliminary Antidumping Duty Determinations on Polyester Textured Yarn from China and India

On June 26, 2019, the U.S. Department of Commerce announced the affirmative preliminary determinations in the antidumping duty (AD) investigations of imports of polyester textured yarn from China and India, finding that exporters from China have dumped polyester textured yarn in the United States at margins of 76.07 percent and 77.15 percent, while exporters from India have dumped polyester textured yarn in the United States at margins of 17.88 percent and 35.92 percent.

As a result of today’s decisions, Commerce will instruct U.S. Customs and Border Protection (CBP) to collect cash deposits from importers of polyester textured yarn from China and India based on these preliminary rates.

In 2017, imports of polyester textured yarn from China and India were valued at an estimated $35 million and $19.6 million, respectively.

The petitioners are Unifi Manufacturing, Inc. (Greensboro, NC) and Nan Ya Plastics Corp. America (Lake City, SC).

The strict enforcement of U.S. trade law is a primary focus of the Trump Administration. Since the beginning of the current Administration, Commerce has initiated 168 new antidumping and countervailing duty investigations – this is a 211 percent increase from the comparable period in the previous administration.

Antidumping and countervailing duty laws provide American businesses and workers with an internationally accepted mechanism to seek relief from the harmful effects of the unfair pricing of imports into the United States. Commerce currently maintains 484 antidumping and countervailing duty orders which provide relief to American companies and industries impacted by unfair trade.

Commerce is scheduled to announce the final determinations on or about November 14, 2019.

If Commerce’s final determinations are affirmative, the U.S. International Trade Commission (ITC) will be scheduled to make its final injury determinations on or about December 28, 2019. If Commerce makes affirmative final determinations of dumping, and the ITC makes affirmative final injury determinations, Commerce will issue AD orders. If Commerce makes negative final determinations of dumping, or the ITC makes negative final determinations of injury, the investigations will be terminated and no orders will be issued.

Army Fitness Uniform Contract Awarded

Federal Prison Industries (UNICOR), Washington, District of Columbia., has been awarded a maximum $14,141,250 modification (P00002) exercising the first one-year option period of a one-year base contract (SPE1C1-18-D1069) with two one-year option periods for Army physical fitness uniform trunks. This is an indefinite-delivery contract. Locations of performance are Minnesota, Colorado, Louisiana and Kentucky, with a July 11, 2020, performance completion date. Using military service is Army. Foreign Sourcing in Government Procurement

According to a recent Government Accountability Office REPORT the U.S. government awarded contracts valued at about $12 billion to foreignlocated firms, of which about $5 billion went to firms with reported locations in the other six main parties to the World Trade Organization Agreement on Government Procurement (GPA) and the North American Free Trade Agreement (NAFTA) (see figure). Conversely, government procurement databases indicated the central governments of these parties awarded an estimated $7 billion to foreign sources, out of which about $2 billion was U.S.-sourced. Canada and Mexico awarded most of the U.S.-sourced contracts. GAO was able to determine that the U.S. government awarded more, by contract value, to foreign-owned firms located abroad than to foreign-owned, U.S.-located firms. Moreover, more than 80 percent of U.S. government contracts awarded to foreign-owned firms located abroad were Department of Defense contracts performed abroad. Overall, while available contract data enable broad crosscountry comparisons, they do not necessarily show where the goods are produced, where the services are delivered, or where the profits go, among other economic effects.

Customs 2019 Trade Symposium Set for July 23-24, in Chigago

U.S. Customs and Border Protection will convene the 2019 Trade Symposium in Chicago, IL, on Tuesday, July 23, 2019, and Wednesday, July 24, 2019. The format of the 2019 Trade Symposium will be general sessions on the first day and breakout sessions on the second day. The 2019 Trade Symposium will feature panels composed of agency personnel, members of the trade community and other government agencies. The panel discussions will address trade remedies, e-commerce, the status of affairs in the Northern Triangle (El Salvador, Guatemala, Honduras), the 21st Century Customs Framework, forced labor issues, and other topics. In addition, there will be a working session to obtain feedback on export modernization and one-on-one sessions with the Centers of Excellence and Expertise.

Carbon Fiber FTZ Application Filed, Comments Dues August 5, 2019

On June 24, 2019, the Foreign-Trade Zone Board published in the Federal Register (84 FR 29496) Notification of Proposed Production Activity; Teijin Carbon Fibers, Inc. (Polyacrylonitrile-Based Carbon Fiber); Greenwood, South Carolina

The South Carolina State Ports Authority, grantee of FTZ 38, submitted a notification of proposed production activity to the FTZ Board on behalf of Teijin Carbon Fibers, Inc. (TCF), located in Greenwood, South Carolina. The notification conforming to the requirements of the regulations of the FTZ Board (15 CFR 400.22) was received on June 7, 2019.

The applicant indicates that it will be submitting a separate application for FTZ designation at the TCF facility (currently under construction) under FTZ 38. The facility will be used for the production of polyacrylonitrile-based (PAN) carbon fiber. Pursuant to 15 CFR 400.14(b), FTZ activity would be limited to the specific foreign-status materials and components and specific finished product described in the submitted notification (as described below) and subsequently authorized by the FTZ Board.

Production under FTZ procedures could exempt TCF from customs duty payments on the foreign-status components used in export production. On its domestic sales, for the foreign-status materials/components noted below, TCF would be able to choose the duty rate during customs entry procedures that applies to carbon fiber (duty free). TCF would be able to avoid duty on foreign-status components which become scrap/waste. Customs duties also could possibly be deferred or reduced on foreign- status production equipment.

The components and materials sourced from abroad include sizing agent, spinning oil, 12,000 tow PAN precursor and 24,000 tow PAN precursor (duty rate ranges from 5.3% to 7.5%). The request indicates that certain materials/components are subject to special duties under Section 301 of the Trade Act of 1974 (Section 301), depending on the country of origin. The applicable Section 301 decisions require subject merchandise to be admitted to FTZs in privileged foreign status (19 CFR 146.41).

Ranee’s Recalls Women’s Beach Cover-ups Due to Violation of Federal Flammability Standard

Description: This recall involves Ranee’s 100% viscose sheer beach and pool tunic styled cover-up. The cover-up is tan and cream in color. The neckline, arm openings and front hem of the cover-up are embellished with gold sequins and tan thread. The neck label states “Ranee’s.” The cover-up was sold in size XXL.

Remedy: Consumers should immediately stop using the beach cover-ups and contact Ranee’s for a full refund.

USTR Announces Product Exclusion Process for China 301 Tranche #3

On June 30, 2019, at noon EDT: The web portal for submitting exclusion requests - http://exclusions.USTR.gov - will open.

September 30, 2019, is the deadline for submitting exclusion requests.

Responses to individual exclusion requests are due 14 days after the request is posted on USTR’s online portal. Any replies to responses to an exclusion request are due the later of 7 days after the close of the 14-day response period, or 7 days after the posting of a response.

In a notice published on September 21, 2018 (83 FR 47974), the Trade Representative, at the direction of the President, announced a determination to modify the action being taken in the Section 301 investigation by imposing 10 percent additional duties on products of China with an annual trade value of approximately $200 billion. On September 28, 2018 (83 FR 65198), the Trade Representative issued a conforming amendment and modification of the September 21 action. The current notice refers to the September 21 action, as modified by September 28 notice, as the “September 2018 action.” In a notice published on May 9, 2019 (84 FR 20459), the Trade Representative, at the direction of the President, increased the rate of additional duty for the September 2018 action to 25 percent.

USTR invites interested persons, including trade associations, to submit requests for exclusion from the additional duties under the September 2018 action. USTR will evaluate each request on a case-by-case basis, taking into account the asserted rationale for the exclusion, whether the exclusion would undermine the objective of the Section 301 investigation, and whether the request defines the product with sufficient precision. Any exclusion will be effective starting from the September 24, 2018 effective date of the September 2018 action, and extending for one year after the publication of the exclusion determination in the Federal Register. USTR will periodically announce decisions on pending requests.

Set out below is a summary of the information to be entered on the exclusion request form.

Each requester has to provide contact information, including the full legal name of the organization making the request, whether the requester is a third party (law firm, trade association, or customs broker) submitting on behalf of an organization or industry, and the primary point of contact (requester and/or third party submitter). The requester may report whether the requester’s business satisfies the Small Business Administration’s size standard for a small business, which are identified by North American Industry Classification Systems Codes and are found in 13 CFR 121.201.

With regard to product identification, any request for exclusion must include the following information:

  • The 10-digit subheading of the HTSUS applicable to the particular product requested for exclusion. If no 10-digit subheading is available (i.e. the 8-digit subheading does not contain breakouts at the 10-digit level), requesters should use the 8-digit subheading and add “00”. Different models classified under different 8-digit or 10-digit subheadings are considered different products and require separate exclusion requests.
  • Product name and a detailed description of the product. A detailed description of the product includes, but is not limited to, its physical characteristics (e.g., dimensions, weight, material composition, etc.). Requesters may submit a range of comparable goods within the product definition set out in an exclusion request. Thus, a product request may include two or more goods with similar product characteristics or attributes. Goods with different SKUs, model numbers, or sizes are not necessarily different products.
  • The products function, application (whether the product is designed to function in or with a particular machine or other device), principal use, and any unique physical features that distinguish it from other products within the covered 8-digit HTSUS subheading. Requesters may submit attachments that help distinguish the product (e.g., CBP rulings, photos and specification sheets, and previous import documentation). Documents submitted to support a requester’s product description must be made available for public inspection and contain no BCI. USTR will not consider requests that identify the product using criteria that cannot be made available for public inspection. Requesters must provide their relationship to the product (Importer, U.S. Producer, Purchaser, Industry Association, Other) and provide specific data on the annual quantity and value of the Chinese-origin product, domestic product, and third-country product the requester purchased, in 2017, 2018, and the first quarter of 2019. Requesters must provide information regarding their company’s gross revenues for 2018, the first quarter of 2018, and the first quarter of 2019. For imports sold as final products, requesters must provide the percentage of their total gross sales in 2018 that sales of the Chinese-origin product accounted for. For imports used in the production of final products, requesters must provide the percentage of the total cost of producing the final product(s) the Chinese-origin input accounts for and the percentage of their total gross sales in 2018 that sales of the final product(s) accounted for.

With regard to the rationale for the requested exclusion, each requester will be asked to address the following:

  • Whether the particular product is available only from China and whether the particular product and/or a comparable product is available from sources in the United States and/or in third countries. The requester must provide an explanation if the product is not available outside of China or the requester is not sure of the product availability.
  • Whether the requester has attempted to source the product from the United States or third countries.
  • Whether the imposition of additional duties (since September 2018) on the particular product has or will cause severe economic harm to the requester or other U.S. interests.
  • Whether the particular product is strategically important or related to “Made in China 2025” or other Chinese industrial programs. In addressing each factor, the requester should provide support for their assertions. To provide information about the possible cumulative effects of the Section 301 tariff actions, requesters also may submit information about any exclusion requests submitted by the requester under the initial $34 billion tariff action (Docket ID: USTR2018-0025) or the additional $16 billion tariff action (Docket ID: USTR-2018-0032) and the value of the requester’s imports applicable to the previous tariff actions. Requesters also may provide any other information or data that they consider relevant to an evaluation of the request.

Army Collapsible Fabric Tank Contract Awarded

GTA Containers Inc., South Bend, Indiana, was awarded a $14,706,913 firm-fixed-price contract for procurement of collapsible fabric tanks. Two bids were solicited with two bids received. Work will be performed in South Bend, Indiana, with an estimated completion date of Dec. 6, 2022. Fiscal 2019 Army working capital funds in the amount of $14,706,913 were obligated at the time of the award. On June 7, 2019, the Consumer Product Safety Commission published in the Federal Register (84 FR 26653) Agency Information Collection Activities; Proposed Collection; Comment Request; Third Party Testing of Children’s Products.
The Consumer Product Safety Commission has submitted to the Office of Management and Budget (OMB) a request for extension of approval of a collection of information for Third Party Testing of Children’s Products, approved previously.

CPSC estimates that approximately 300,000 non-apparel children’s products and approximately 1.2 million children’s apparel and footwear products are covered by the rules.

Manhattan U.S. Attorney Announces Criminal And Civil Charges Against CEO Of Clothing Company For Million-Dollar Customs Fraud

Geoffrey S. Berman, the United States Attorney for the Southern District of New York, Angel M. Melendez, the Special Agent in Charge of the New York Office of the U.S. Department of Homeland Security, Homeland Security Investigations (“HSI”), and Troy Miller, Director, Field Operations, New York, U.S. Customs and Border Protection (“CBP”), announced today the filing of criminal and civil charges against JOSEPH BAILEY, the CEO of a children’s apparel company headquartered in Manhattan. BAILEY was charged, in an indictment unsealed today, with participating in a years-long scheme to defraud U.S. Customs and Border Protection (“CBP”) by submitting invoices to CBP that falsely understated the true value of the goods his company imported into the United States. BAILEY’s scheme resulted in the loss of over $1 million in duty revenue to the United States.

Department of Defense Tent Contract Awarded

HDT Expeditionary Systems Inc., Solon, Ohio, has been awarded a maximum $200,000,000 firm-fixed-priced, indefinite-delivery/indefinite-quantity contract for commercial off-the-shelf shelters and tents. This was a competitive acquisition with one response received. This is a one-year base contract with three one-year option periods. Locations of performance are Alabama, Ohio, Virginia and Kentucky, with a June 4, 2020, performance completion date. Using military services are Army, Navy, Air Force and Marine Corps. Type of appropriation is fiscal 2019 through 2020 defense working capital funds. The contracting activity is the Defense Logistics Agency Troop Support, Philadelphia, Pennsylvania (SPE1C1-19-D-1158).

Suit Charges Berry Amendment Fraud

In a case filed May 21, 2019, in the United States District Court for the District of Rhode Island, the United States charged a wholesaler of military uniform items and gear with Conspiracy to Commit Wire Fraud and Trafficking in Counterfeit Goods.

The complaint charges conspiracy to defraud and unlawfully obtain over $20,000,000 in funds from the United States government and from wholesalers who supply the United States government, by trafficking in counterfeit military uniforms and gear that were falsely represented to be Berry Amendment or TAA compliant, that is, manufactured in the United States or a designated country. The apparel not only was made in China, it was also not flame resistant as required by the contract and claimed on the garments.

ICE Homeland Security Investigations warns consumers about counterfeit sports merchandise, tickets during NBA finals

With the NBA Finals presented by YouTube TV in full swing, the U.S. Immigration and Customs Enforcement (ICE) Homeland Security Investigations (HSI) led National Intellectual Property Rights Coordination Center and HSI San Francisco warned the public Friday to beware of purchasing counterfeit sports apparel and tickets to games and other events.

"The enthusiasm around these high-profile sports events is meant to be a time for fans to celebrate," said IPR Center Director Steve Francis. "Instead, organized criminals are preying on that excitement, ripping consumers off with counterfeit merchandise and stealing from the American brand holders who play by the rules."

Fake jerseys, ball caps, t-shirts, jackets and other souvenirs are among the counterfeit merchandise and clothing typically sold during these events. Additionally, authorities have seen an increase in the sale of counterfeit tickets being sold to these events. Large sporting events such as the NBA Finals presented by YouTube TV are prime targets for counterfeiters, many of whom travel the country or set up phony websites with the sole intention of scamming sports fans.

“Not only is counterfeiting harmful to the local economy and local retailers, it has a negative effect on our fans,” said Ayala Deutsch, Executive Vice President and Deputy General Counsel for the NBA. “We know they want an authentic experience and official souvenirs to remember this time, so our goal is to ensure that they’re armed with tips and tools to recognize fraudulent tickets and products and reduce the risk of purchasing fakes.”

HSI and partner agencies regularly team up with state and local law enforcement during significant sporting events.

“HSI San Francisco is committed to conducting intellectual property theft investigations that not only protect the companies who have trademarked licensed products, but also the consumers who believe they are buying authentic products,” said Ryan L. Spradlin, Special Agent in Charge, HSI (San Francisco and Northern California). “When fans spend their hard-earned money on tickets and merchandise, they deserve the real deal.”

The International Trade Administration estimated in 2016 that counterfeiting and piracy cost the U.S. economy, annually, between $200 billion and $250 billion and 750,000 jobs.

“Trafficking counterfeit merchandise/products which often have unknown ingredients or are constructed with substandard materials poses a significant public safety risk not to mention how it hurts legitimate U.S. businesses, preys on unsuspecting fans who believe they are making legitimate purchases while saving a buck and funds Transnational criminal organizations engaged in varying types of illegal activities. Our consumers should know, this isn’t a victimless crime. We aren’t just talking about fake t-shirts here,” Spradlin said.

Although counterfeiters are increasingly more sophisticated, fans can keep several key factors in mind when making purchases to avoid being victimized:

  • Shop at authorized retail locations, such as the official team stores rather than buying items from street vendors, flea markets, online auctions or other questionable sources
  • Buy tickets from authorized dealers
  • Look out for ripped tags or irregular markings on apparel
  • If the price seems too good to be true, it probably is. While some counterfeiters may attract fans with a low price tag or 2-for-1 deal, just as many try to legitimize their merchandise with a higher price point.

Purchasing authorized merchandise guarantees the quality and life of that souvenir, while also providing a reputable source for concerns, returns, and exchanges.

Increase to 25% on Section 301 List 3 Tariffs to be Delayed.

On May 31, 2019, the U.S. Trade Representative’s Office (USTR) announced USTR intends to publish a notice in the Federal Register shortly that extends the amount of time for importers to enter certain goods exported from China before the goods will be subject to an additional tariff increase from 10 percent to 25 percent.

Covered products that were exported from China to the United States prior to May 10, 2019 will remain subject to an additional 10 percent tariff if they enter for consumption into the U.S. before June 15, 2019. Originally, the deadline to enter the U.S. before the goods would be subject to an additional 25 percent tariff was June 1, 2019.

This limited extension will further account for customs enforcement factors and the transit time between China and the United States by sea.
