CBP Reminds Consumers to Beware of Counterfeit Goods When Shopping this Holiday Season

With Black Friday and Cyber Monday fast approaching, U.S. Customs and Border Protection (CBP) is reminding consumers to be on the lookout for counterfeit and pirated goods, particularly when shopping online.

Every year, CBP seizes millions of counterfeit goods from countries around the world as part of its mission to protect U.S. businesses and consumers. These goods include fake versions of popular products, such as smartphones and related accessories, electronics, apparel, shoes, cosmetics, and high-end luxury goods. Sold online and in stores, counterfeit goods hurt the U.S. economy.

Happy Thanksgiving Day from Agathon Associates

Agathon Associates, will be closed Thursday, November 26th, in celebration of Thanksgiving Day, a major holiday in the United States. All government offices and most businesses will be closed for the day. Many business, other than retail, will also be closed on Friday, the 27th.

In other years Pilgrims, Plymouth Rock, Poultry, Pumpkin Pie, and large gatherings of friends and family would all be on the menu tomorrow as we Americans of every origin re-enact and re-interpret the story of that first Thanksgiving in 1621. Somehow, in the story of those Englishmen and women of a strict Calvinist religion, we find meanings to suit the needs of a multi-ethnic and multi-religious nation. Now in time of Great Sickness and Mortality we all shall scale back our festivities. Perhaps this year we shall especially note that out of 102 Mayflower passengers, merely 51 survived the first winter in New England.

Thanksgiving 2020 brings a special Four Hundredth Anniversary commemoration. Originally headed for the northern part of the Virginia Colony -- roughly in the area where New York City is now located -- they ended up landing off-course, up here in what would become New England. Being out of the bounds of any established colony, where a colonial charter formed the basis for civil society, the Mayflower passengers found themselves, technically, outside of the law. Their response? They would remain loyal subjects of the king, but they would create their own local laws. Pilgrims, who made the passage for religious reasons, and others who crossed the Atlantic for commercial gain, agreed to live together in the New World under equal laws created democratically "for the General good."

The Mayflower Compact was signed four hundred years ago on November 11, 1620 (Julian Calendar, the 21st in our Gregorian Calendar) on board the Mayflower at anchor in Provincetown Harbor. In it they agreed to: "solemnly and mutually in the Presence of God and one of another, covenant and combine ourselves together into a civil Body Politick, for our better Ordering and Preservation, and Furtherance of the Ends aforesaid; And by Virtue hereof to enact, constitute, and frame, such just and equal Laws, Ordinances, Acts, Constitutions and Offices, from time to time, as shall be thought most meet and convenient for the General good of the Colony; unto which we promise all due submission and obedience." And, thus, was established the first experiment in limited self-government in North America.

This Thanksgiving may God bless all the readers of the Textiles and Trade BLog with his bounty and with health of body and mind.

Canada successfully concludes talks on transitional trade continuity agreement with the United Kingdom

On November 21, 2020, the Honourable Mary Ng, Minister of Small Business, Export Promotion and International Trade, along with Elizabeth Truss, the United Kingdom’s Secretary of State for International Trade, announced the successful conclusion of talks for the Canada-United Kingdom Trade Continuity Agreement - an interim deal that will be in place as Canada and the United Kingdom work towards negotiating a comprehensive free trade agreement.

As CETA will no longer apply to the United Kingdom beginning January 1, 2021, this new agreement will provide continued access to the benefits of CETA on a bilateral basis, including the elimination of tariffs on 98% of Canadian products exported to the United Kingdom. This will provide a competitive edge to Canadian exporters and businesses who will maintain preferential access to the United Kingdom market, even as the country exits the EU.

This agreement is intended to provide stability and predictability for businesses, exporters, and workers in both Canada and the United Kingdom. Canada and the United Kingdom have long shared a profound and positive relationship, with a long history of working closely together.

Hardwood Products Awarded $11.6 Million Contract for Flock Tip Medical Swabs

Hardwood Products Co. LP, Guilford, Maine, has been awarded a not-to-exceed $11,640,270 firm-fixed-price, undefinitized contract action as a modification (P00003) to contract FA8730-20-C-0056 for industrial base expansion for U.S. domestic production capacity for medical flock tip swabs. This contract modification funds the design, procurement and expedited implementation of facility upgrades, enabling an early, interim production capability of flock tip swabs. Work will be performed in Pittsfield, Maine, and is expected to be completed March 30, 2021. Fiscal 2021 other procurement funds in the amount of $5,078,350 are being obligated at the time of award. The cumulative face value of the contract is $62,599,861. The Air Force Life Cycle Management, Hanscom Air Force Base, Massachusetts, is the contracting activity.

Joint Statement on Hong Kong

The text of the following statement was released by the Governments of the United States of America, Australia, Canada, New Zealand, and the United Kingdom.

We, the Foreign Ministers of Australia, Canada, New Zealand, and the United Kingdom, and the United States Secretary of State, reiterate our serious concern regarding China’s imposition of new rules to disqualify elected legislators in Hong Kong. Following the imposition of the National Security Law and postponement of September’s Legislative Council elections, this decision further undermines Hong Kong’s high degree of autonomy and rights and freedoms.

China’s action is a clear breach of its international obligations under the legally binding, UN-registered Sino-British Joint Declaration. It breaches both China’s commitment that Hong Kong will enjoy a ‘high degree of autonomy’, and the right to freedom of speech.

The disqualification rules appear part of a concerted campaign to silence all critical voices following the postponement of September’s Legislati

ve Council elections, the imposition of charges against a number of elected legislators, and actions to undermine the freedom of Hong Kong’s vibrant media.

We call on China to stop undermining the rights of the people of Hong Kong to elect their representatives in keeping with the Joint Declaration and Basic Law. For the sake of Hong Kong’s stability and prosperity, it is essential that China and the Hong Kong authorities respect the channels for the people of Hong Kong to express their legitimate concerns and opinions.

As a leading member of the international community, we expect China to live up to its international commitments and its duty to the people of Hong Kong. We urge the Chinese central authorities to re-consider their actions against Hong Kong’s elected legislature and immediately reinstate the Legislative Council members.

Advisory to the Trade: Temporary Duty Suspensions May Expire at the End of the Year

If you have been benefiting from import duty suspensions relating to certain articles, TAKE NOTE. These temporary duty suspensions are scheduled to expire after December 31, 2020. Unless congress acts between now and then the duty suspensions will expire and revert to the normal rate of duty.

It is the consensus of trade professionals in Washington that congress is likely to fail to act in a timely manner on renewing these duty suspensions. Further, it is the consensus of trade professionals that when congress reconvenes in January issues relating to the physical health and economic well being of the American people will likely be the priority and trade-related matters are likely to be delayed. THEREFORE, our advice to clients enjoying duty suspensions is, wherever possible, to accelerate early 2021 shipments into the remaining weeks of 2020.

This recommendation is based on (1) the deep partisan divide between the Democratic majority in the House and the Republican majority in the Senate, (2) pressing COVID-19-related needs for legislative actions, which themselves may be delayed by partisanship, and (3) the sad history of congressional delays in acting on the Miscellaneous Tariff Bill, the vehicle for enacting the duty suspensions. Most recently, the failure to act in 2017 resulted in the current duty suspensions, which were intended to take effect January 1, 2018, being delayed until October 13, 2018.

Tent Contract Awarded

Outdoor Venture Corp., Stearns, Kentucky, has been awarded a maximum $37,464,448 firm-fixed-price, indefinite-delivery/indefinite-quantity contract for the Modular General Purpose Tent System and components. This was a competitive acquisition with two responses received. This is a one-year base contract with four one-year option periods. Location of performance is Kentucky, with a Nov. 4, 2021, ordering period end date. Using military services are Army, Navy, Air Force and Marine Corps. Type of appropriation is fiscal 2021 through 2022 defense working capital funds. The contracting agency is the Defense Logistics Agency Troop Support, Philadelphia, Pennsylvania (SPE1C1-21-D-1404).

Sound the Alarm: Pants Do Catch Fire; CPSC Urges Seniors to Stay Vigilant About Clothing Fire Safety

Did you know that older Americans (over 65) are one of the groups at greatest risk of dying in a fire? Seniors are 16% of the population, but they account for 77% of the deaths from clothing fires.  The U.S. Consumer Product Safety Commission (CPSC) wants to sound the alarm on this sobering statistic, by reminding our senior community to stay vigilant about fire safety. 

“All clothing can burn,” says CPSC Acting Chairman Robert Adler. “And the loose clothing often favored by seniors can catch fire especially easily,” he added.

Whether it’s a dangling sleeve over the stove top, or food left unattended – cooking accidents are the leading cause of fires in the home. But you may be surprised to know that burning trash, grass and debris outdoors is also a leading cause of clothing fire injuries to seniors. Using space heaters improperly also tops the list. So, what is catching fire? The leading clothing item ignited and causing these injuries is pants, followed by shirts, night gowns and robes.  Here’s how the numbers break down.

CPSC estimates there were about 1,100 emergency room visits per year associated with senior clothing fire injuries from 2015 to 2019. This includes both fires in the home and outdoor fires. 

  • An estimated 22% of these injuries are from cooking fires;

  •  21% are from burning trash/grass/debris; and

  • 12% are from space heater fires. 

According to the National Fire Incident Reporting System (NFIRS), there are an estimated annual average of 60 clothing fire deaths to seniors per year. Of these clothing fire deaths to senior citizens:

  • 24% are from “Range, Oven” fires;  

  • 23% are from smoking material-ignited fires; and

  • 11% are from heater fires.  

CPSC is releasing a new Public Service Announcement (PSA) to warn older consumers about this hazard, and to show how these types of fires can be prevented. 

The vast majority of these fires are highly preventable. Here’s how you can be fire safe:

  • All Clothing Burns: Keep all clothing away from flames and ignition sources. Loose clothing can catch fire easily. 

  • Cook with Care: Keep sleeves and dangling clothing components away from the cooktop.

  • Outdoor Fire Safety: When burning trash and yard debris, keep a safe distance from any outdoor fire, and keep lighter fluid off clothing. Follow CDC guidelines regarding outdoor burning during the COVID 19 pandemic.

  • Space Heater Safety: Loose pants and robes in close proximity to a space heater can catch fire. Space heaters need space.

  • If You Smoke: Smoking materials can ignite clothing. Don’t smoke while drowsy; safely extinguish smoking material.

  • Extra Precaution: Have a fire extinguisher nearby, and place working smoke alarms on every floor outside sleeping areas and inside bedrooms. 

If clothing does catch fire, according to the CDC and the National Fire Prevention Association, stop (don't run), drop and roll. Cover your face. Roll until the fire is out. If you're not able to drop, use something like a blanket to put out the flames. Run cool water on your burn until emergency responders arrive.

Army Boot Contract Awarded

McRae Industries Inc., Mt. Gilead, North Carolina, has been awarded a maximum $7,940,873 modification (P00007) exercising the third one-year option period of a one-year base contract (SPE1C1-18-D-1011) with four one-year option periods for hot-weather combat boots. This is a firm-fixed-price, indefinite-delivery/indefinite-quantity contract. Location of performance is North Carolina, with a Nov. 13, 2021, ordering period end date. Description: This recall involves InvoSpa electric throw heated blankets. The recalled blankets measure 50 inches by 60 inches. The blankets are made of silky flannel and sherpa shu velveteen and are white and gray. Model number ML-G03 and InvoSpa are printed on a tag on the blanket.

United States Responds to European Union Tariff Announcement

On November 9, 2020, United States Trade Representative Robert E. Lighthizer responded to the announcement by the European Union imposing tariffs on certain products from the United States.

“The United States is disappointed by the action taken by the EU today,” Ambassador Lighthizer stated. “The alleged subsidy to Boeing was repealed seven months ago. The EU has long proclaimed its commitment to following WTO rules, but today’s announcement shows they do so only when convenient to them.”

Background

As part of a 16-year-old litigation involving large civil aircraft, the EU alleged that a certain Washington State tax provision benefited Boeing. In response to a WTO panel decision, Washington State unambiguously repealed this tax provision on April 1, 2020. Under such circumstances, a WTO member cannot unilaterally impose retaliatory tariffs on a trading partner.

The USTR is in negotiations with the EU with the hope of resolving this longstanding dispute relating to large civil aircraft.

CBP intercepts $9.3M in counterfeit designer merchandise

The largest holiday shopping season is underway and counterfeiters are eager to fool U.S. consumers into purchasing goods. U.S. Customs and Border Protection officers working at the Dallas Fort Worth port of entry intercepted a shipment of counterfeit footwear, handbags, and textiles worth over $9.3 million dollars. This shipment of counterfeit designer merchandise originated in China and was destined for McKinney, Texas.
