Tariff Suspensions and Reductions Effective Tomorrow

The long-awaited Miscellaneous Tariff Bill duty suspensions and reductions go into effect for goods entered, or withdrawn from warehouse for consumption, on or after Saturday, October 13, 2018.

In fourth quarter of 2016, the U.S. International Trade Commission accepted petitions for temporary duty suspensions on articles not available domestically. After the ITC, with input from the U.S. Department of Commerce and U.S. Customs ad Border Protection, did a thorough analysis of each request, a list of recommended duty suspensions and reductions was submitted to congress. The expectation was that congress and the president would act in fourth quarter 2017, with the result that the suspensions and reductions would go into effect around January 1, 2018. However, in the current climate in Washington, the process was delayed and the MTB was not enacted until September 13, 2018, with an effective date 30 days thereafter.

For an item to be included in the final MTB is was necessary:

  1. that no domestic producer of the product objected,
  2. that Customs could enforce the provision (objective description of the article, not a request made based on an end use), and
  3. that no single provision would result in more than $500,000 in lost tariff revenue.

As regards that third provision, you will note that in some cases, such as in the case of acrylic fiber, a single article was sub-divided into several provisions so that no single request exceeded the monetary cap. In other cases, for example, in the case of footwear, the duty will be reduced, but not entirely suspended, in order to stay under the monetary cap.

With suspensions and reductions being implemented on the weekend, there is some confusion. For example, the Harmonized Tariff Schedule, as published on the website of the ITC still, as of this morning, has not been updated to reflect these changes.

Yesterday Customs notified brokers that:

"Harmonized System Update (HSU) 1816 was created on October 10, 2018 and contains 6,042 ABI records and 1,516 harmonized tariff records. This update includes modifications made as a result of H.R. 4318: Miscellaneous Tariff Bill Act of 2018. The modified records are currently available to all ABI participants and can be retrieved electronically via the procedures indicated in the CATAIR."

Therefore, your customs broker should be able to file your entries, starting tomorrow, with the duty suspensions or reductions.

IMPORTANT NOTES 1. The Customs Entry Summary Form, CBP Form 7501" does not have room for the long descriptions of the articles subject to the duty suspensions or reductions. That's okay, just be sure to maintain documentation showing that the article corresponds to the full description. 2. In the case of duty suspensions that were in effect in the past and are being re-instated, NOTE, that the Chapter 99 classification number has changed. All the old, expired provisions were completely deleted and new ones created, even if the new one is identical to the old one. In the past as new duty suspensions were created they were added after the existing ones, with the result that the order in which they were listed reflected more the chronology of the process than the character of the articles. Now the duty suspensions are listed in an order that reflects the order of the statistical classification of the goods in the tariff schedule, meaning provisions relating to fiber are all near each other, followed by provisions relating to yarn, followed by provisions relating to apparel, and so forth. 2. Customs can ask for additional proof, including laboratory analysis. Especially in the case of new provisions, where the inspector at the local port may not be familiar with the articles, there may be some question initially. You'll probably have no problems, and if you do they will likely go ago once a few shipments have come through and Customs becomes familiar with your products. 3. In drafting the provisions filed by Agathon Associates on behalf of clients, we described the articles using the definitions in Fairchild's Dictionary of Textiles, a source that Customs frequently cites, so we should be able to get Customs on the same page with us regarding definitions. 4. The duty suspensions and reductions relate only to the general import duty ("column 1 duty"). The suspensions have no effect on Section 232 duties on steel and aluminum or Section 301 duties on certain articles from China. For example, cashmere yarn has a 4% general column 1 duty. Since September 24th, cashmere yarn from China has been subject to an addition 10% Section 301 duty, for a total of 14%. Starting Saturday the 4% is removed, but, in the case of yarn from China, the 10% remains.
