Victory for U.S. Manufacturing, Dept. of Commerce Says 70-90% Circumvention of AD/CVD Duties on Amorphous Silica Fabric from China, Will Enforce Orders

On September 6, 2022, the International Trade Administration published in the Federal Register (87 FR 54458) [A–570–038, C–570–039] Certain Amorphous Silica Fabric From the People’s Republic of China: Preliminary Affirmative Determinations of Circumvention.

As detailed in the Preliminary Decision Memorandum, the government preliminarily determined that 70–90 percent ASF produced in China and exported to the United States is circumventing the Orders. The International Trade Administration has instructs U.S. Customs and Border Protection (CBP) to suspend liquidation of entries of 70 and 90 percent ASF produced in China and exported to the United States, and to require cash deposits of estimated antidumping and countervailing duties.
